This is something I thought of a while ago, and since I'm too lazy to look it up properly, I'll just see if anyone here knows the answer.
The US and Iraq are at war, correct? Or if the war somehow technically has been declared as over, they were at war at some point in time.
It seems to me, that when in war, civilian causalties goes unpenalized (as opposed to killing someone in peace time, which is murder, or manslaughter, but there's always consequences for the one doing it), since it's war.
Case in point: US soldiers kill civilians every day, yet the only trials I've heard about are those concerning the violation of human rights, which indicates that some things are OK to do, and others not. Note: I'm not trying to point out the US specifically as "killing civilians", it's just the most obviouos example.
I guess there's a law about it somewhere, saying something like "When two countries are at war, if people from those countries kill each other, it's OK". I write "people", since I don't think a civilian knifing a soldier trying to kill his daughter is punished either. It's war, after all.
So, now for my point.
Is it "OK", as in "We can't prosecute him for this", for Iraqis in the US, to kill Americans without any reason, or perhaps if he says "It looked like he was going to hurt me!", as long as the US and Iraq are at war?
If anyone has some links where the laws of war are detailed in a easy-to-understand fashion, post them here.

We didn't officially declare war on Iraq, so this is like the Vietnam "War" or the Korean "War".

You make sort of an interesting point that I don't really feel like looking up either. We've blown up over 100K Iraqi civilians (we'll beat those tsunami figures all in good time) and that seems to be OK with everyone.

I had an anal history book which insisted on calling them the "Vietnam Conflict" and "Korean Conflict".
The 100k civilian death count is such BS. The most extreme source I quickly Googled up estimated 15k total.

i am also a big fan of Lu Meng. his musou meter fills quick, and you can kick the fuck out of a general with it fairly easily, since he moves in a straight line. HIGHLY RECOMMENDED!!

I still say that there was the Vietnam War. Just because the U.S. never officially declared war, doesn't mean that it was only a world-wide "conflict" and not a fully-fledged "war".
This could be compared to WWII, among others. I'm sure people in the U.S. from 1939-'42 called it a war, yet the U.S. didn't declare war yet at that time.

But Lark's original point was a technical one, based specifically on what's acceptable during "war". The question was technical in the first place, although I agree that a piece of paper or Congressional approval has little to do with blowing people up in the jungle.

Only Congress has the constitutional right to declare war. WWII was so declared. Congressmen decided people voted against Congressmen who declare war, so they've been trying to avoid doing it since. That gives you two choices:
1) Nothing we've done since WWII has technically been a war.
2) Every war we've been in since WWII has been illegal.
Take your pick.
